Yup, the fact that the ref has no choice but to whistle a foul and therefore give a penalty here (and you can't really argue against it) is basically what's wrong with penalties as a mechanism to punish against fouls in the box.

There has got to be a better way to determine what a dangerous action is than going with a big arbitrary rectangle
