I've wondered this same thing. But I have to think there's some sort of group of right wingers that has studied this extensively and aren't guessing who it hurts the most. I dunno.

GOP districts will not apply the rules, as much as they can get away with. However, Repubs and the media will intensely scrutinise dem seats that can be flipped and cry 'cheat' if the rules are not strictly applied. Even if they are strictly applied, they'll still cry cheat and hold up the results.
