Harvard used race as a criteria for hiring and admission. That's illegal, and that's predicated on leftist ideals of "equity". Positive discrimination is illegal no matter if you think it shouldn't be.

It is illegal to ever take race into consideration in hiring or in admissions. Fully illegal, uncontroversially illegal. No one should do that. Those that do that should be punished by the full extent of the law, and political power should be used to it's fullest extent to punish them as well.

Either that or you have to go on record claiming that provisions of the civil right act that pertain to private actors should all be removed and discrimination by private actors should be legal.

But even if the civil right act, for private actors, was repealed, then Harvard would only be allowed to discriminate if it didn't take one federal or state dollar.

So given Harvard takes public money (and students at Harvard get public subsidies which benefit Harvard to pay for tuition), Harvard wouldn't be allowed to ever take race into consideration even in a world where private freedom of association was allowed.

The law allows the executive to determine who will take the federal grants from the health department (to the most part). What would be the overreach if specific institutions that the executive finds failing and behaving horribly, get less or no money?

The law allows the executive broad latitude in determining who , as alien, can get VISAs. What would be the overreach if Trump decides not to give VISAs to people who want to study or work at Harvard?
