The Trump admin just dismantled the application of "disparate impact" in federal law and executive functions. Very very very very good news, at least on these topics Trump is behaving far better than expected.

I suppose it will be litigated as usual and the hope is this SCOTUS will trash the horrific, disgusting, violently eversive decisions of SCOTUS in recent and last decades kn the topic.

the latest afaik was in 2015, a 5-4 terrible decision (Texas dept v inclusive communities) that allowed disparate impact to be used in FHA cases.

That should all go.

The whole idea is to dismantle all leftist legislation from the bench piece by piece (yes Kennedy sided with the left a bunch of times for many horrible 5-4 decisions), and it is a very good idea long overdue.

if it works even in part, it's a lasting legacy which the next democratic administration can't reverse immediately (unlike say, going back to unlimited, unfiltered immigration) because SCOTUS isn't going left any time soon.

They are arguing to remove parts of the civil rights act, which was duly passed by congress and should be executed by the executive.

It’s textbook unconstitutionality and breach of separation of powers.

In my hometown, the entire city council is MAGA. They recently launched a campaign for an upcoming special election to vote no on a measure, claiming on signs, It's about keeping kids away from porn.

In reality, they are trying to ban sex education books, and claiming this is porn to their constituents.

This has finally woken up the city to the fact these people might not be mentally well. It's all the talk right now, and maybe it will begin to wake more people up.

Disparate impact was invented in Griggs v Duke Power (1971).

the company run IQ tests and that was racists under the civil right act because blacks performed worse at those.

anyway you are completely wrong if you think disparate impact was put into law by Congress. it simply wasn't, go check that, it was invented by SCOTUS.

and the DOJ can stop trying cases according to that theory even before SCOTUS reverses it, don't you agree? you guys told me Biden could completely disregard deportation rules, why doesn't that apply to the DOJ stopping to try to use disparate impact to prove discrimination? what's the unconstitutional idea there? they can decide which laws to prosecute under, which provisions, arbitrarily right? they can pick and choose and only apply what they agree with right? that was your guys idea about immigration laws at least.

can't really have it both ways: either the executive always has to apply the law, or it can always pick and choose.
