I think we should extend this logic, and acknowledge that the US government can now kill dissenters with trebuchets. After all, once airborne the projectile is "just an aggregate of mineral matter" and that the deaths were "simply due to gravity", and it is not like the US government controls geological formation or the fundamental forces of the universe.

That's textualism not originalism and no they aren't the same.

Textualism is "we don't care about intentions of legislators or drafters in the past or present nor the spirit of the law if the text is unambiguous".

Originalism is "any ambiguity about the semantics or the form of expression of the statute or law or amendment and so on has to be solved under the interpretation of those words or paragraphs at the time they were written".

So if the restraining order was issued to DHS and if it was another entity that performed the deportation, how can you claim the DHS violated the order?

Next time issue an order to the whole administration no?

I mean if i get a restraining order against speaking about X in public i can certainly write about it and have another person read it and ... it's fully legal and compliant with the order, unless the order specifically prohibits me from doing that.

1. The order has a standard “agents, partners, etc” clause. You, a single private person, are not the government. Orders against the government generally mean the “entire” government. Even so, if you hired someone take something you wrote and speak on it public, you can be damn sure you’d get dinged for that.

2. Did you notice how the declaration is completely silent as to how these folks got on the plane in the first place? Wonder why that is. You think it’s a good argument that DHS did everything from identifying, to detaining, to transporting them to the airport, but that only the actually flight is “deporting”? Good luck with that one

3. You gonna update us on your position on that immigration statute you said mandates deportation?

What you are describing would be the attempted circumvention of the obvious intent of a court order. If you try and make that sort of argument to a federal judge, you are guaranteed to get eviscerated.
