It now turns out that the constitution always depended on unwritten rules and, when you get a ruler who doesn't care about all that, there's no check. An executive ruler quite separate from the legislature, and unanswerable to it, was probably always going to be a liability, and some of the founders feared they were creating a ruler 'plus roi que le roi', but there it is.
