I am not at all surprised by this decision. Even before the argument, I was very confident that the reciprocal tariffs would be struck and reasonably confident (although not certain) that the drug trafficking tariffs would be struck. And 6-3 or 7-2 was how I expected the vote to go. I was extremely confident that the three liberals plus Gorsuch and Roberts would be in the majority. Gorsuch is a very rigid textualist. He isn't prone to reading between the lines to find implicit rights or implicit delegations of authority. That approach makes him a great justice for the Trump administration on things liked privacy rights, but not such a good justice in this sort of case. Roberts relied very, very heavily on the major questions doctrine to invalidate liberal initiatives like student loan forgiveness. I didn't see any way that he could reconcile those earlier opinions with upholding these tariffs, and I didn't think he was willing to make a fool of himself by trying to do so. I was reasonably confident Barrett would be in the majority for the same reasons as Roberts. I was uncertain about Kavanaugh. Alito and Thomas being in the dissent of course was no surprise.

In his dissent, Kavanaugh noted that the majority didn't say whether or how the tariffs should be refunded (presumably because those questions weren't explicitly before the court), and he did some hand wringing about what a mess it will be. He can **** off with that nonsense. It is beyond absurd to imply that we should allow the president to violate the law if he creates a huge and difficult-to-fix mess by doing so.

Not literally, obviously the ones having to spend the actual dollars are the american importers. Foreigner exporters pay indirectly, by selling less and/or accepting bigger discounts in order to stay competitive, and in the end getting less revenue basically.

May I ask what the **** you are talking about? This opinion doesn't address the question of whether the president can ever play a role in imposing tariffs. It addressed the question of whether a specific statute, IEEPA, gave this president the authority to unilaterally levy these tariffs without any input or endorsement from Congress.

Are you suggesting that legal claims by companies for refunds of these tariffs are destined to fail? What is your reasoning?

1. You COULD answer your own question by doing a little reading, either of the opinion itself or some coverage. Perhaps before you made an assertion about the subject.

2. This may be a unique situation, but historically the US Federal government is probably the quickest and most reliable payor of debts in the entire world. For example - tax returns, Medicare payments, social security, any sort of contract - all of these literally have laws on the books saying how fast the gov must pay. That is one reason why the federal government is one of the easiest orgs to scam.
