Well, the educational status quo is to push everyone through public school regardless of whether they master the material. And the result of this at the demographic level is exactly what an honest person would intuitively expect.

Whether you elect to call this "affirmative action" or not is a matter of personal philosophy and how strict you are with labeling.

This is hugely misleading. Most of the schools you are talking about simply give applicants the option of submitting a GRE score in lieu of an LSAT score.

The correlation between LSAT scores and GRE scores surely is very high.

It's especially weird when people insist they are correct even as to people like KBJ who excelled overwhelmingly in the academic environments to which they were admitted.

KBJ graduated cum laude from Harvard Law School and made law review. I don't know exactly what that means at HLS, but top 10% is a good guess. And that's in an environment where grading was entirely blind. She graduated magna from Harvard undergrad, which probably means top 1-2%. It's nonsensical and wildly counterfactual to presume that she was out of her depth academically because she is a black woman.

Anyway i know you disagree but i don't think we can list many moments in the past where things were actually better, even in the recent past.

I take some of your points, but i also think you are conflating the state of the world with the quality and functionality of government. The world often improves in spite of dysfunctional, incompetent, or unethical government.

That is what happens when you engage in blatant racial profiling and discrimination, and then fight tooth and nail to hide it. I dont make the rules of the game.

That being said, you make your generalizations based on available information; and then as more information comes out you refine them.

Just because I dont assume a lawyer/judge is going to be proficient at mathematical concepts just because they are a lawyer/judge. If any individual has demonstrated either directly or indirectly they are proficient, I am not going to deny the evidence.

You have given enough personal information for me to deduce you are from a demographic they make up quotas to keep them out of higher education, not let them in. I suspect you are intelligent enough if you were of a more desirable demographic you would literally have gotten into any college/major you wanted.

Maybe you did anyways, and are living the life you always wanted. I dont know.

People seem to be insinuating that there are Article 3 judges without law degrees. That is not the case.

If you are simply highlighting another norm that theoretically be abused by people who don't care about competence, the rule of law, or good government, then fair enough, I suppose.

Afaik not even trump nominated anyone for an article 3 judicial spot who wasn't a lawyer .

But yes it's yet another norm which should be amended to remove the option for people to abuse it (and in the far past some weird people have sit in SCOTUS)

Maybe some of this is just ignorance on your part. If I meet a successful commercial litigator who works on complex matters, I am going to assume that the person has a functional level of math literacy, regardless of whether the person has purple skin, four vaginas, or a penis growing out of his forehead. Why? Because I know that person in all likelihood has experience deposing and cross-examining experts about sampling methodology, regression analyses, DCF models, confidence intervals, detailed accounting issues, etc. It isn't possible to do that effectively without a functional level of math literacy.

Yet in one of chapter he specifically give out clear reason on why he is against affirmation actions even though it benefit black people.

Also I use to have the thought experience that since other people couldn't afford pio solver or since I got lucky to play on a soft site there was no way they would be able to climb up from micro stake poker and get out of the rake trap. I would feel sorry for these people if only they have the same resource. Later after solvers got cheaper and a lot of resource got posted out there, I egg a bunch of poker guys to get it and study. I even offer free coaching. Yet they would take up one or two lesson and give up. Ask yourself why can't you beat micro stake online poker when there so many resource out there? I came to realize that maybe certain people are natural good at certain things because they are motivated to achieve it. You can give out all sort of cheap/free stuff and these people just aren't going to be interested.

I would be shocked if there has been a federal judge in my lifetime who did not have a law degree. But sure. We live in strange times. And for that reason, I would support an explicit requirement that federal judges have law degrees.

It is possible I am discounting the cognitive requirements of being a lawyer.

I have a lot of doctors in my family/circle, but not lawyers. And based on personal experience I would definitely not say being a doctor means one should assume an understanding of mathematical concepts.

I have seen family law lawyers in Italy use calculators to come up with 1/4 of a round number when calculating inheritances (like needing a calculator to do 120k / 4) , and it was basically only people who wanted to have a decent job but hated numbers that went to study law among my high school colleagues and acquaintances. but i understand it's different here (we don't have the law school thing after a different undergraduate program here: we have law the same as economics or everything else, you start it at year 1 of your university).

In fact skilled fiscal lawyers are extremely rare and they earn a ton more than basically all other lawyers around here. 90-95% of what someone would think a fiscal lawyer should do is done by accountants here (who study more law than in other countries, like 7-8 law exams in their university courses), but they have 0 skills if it ever goes to trial.

So being a fiscal lawyer able to go to trial to defend a company against our IRS equivalent demands is basically printing gold here.
