What's currently controversial and not yet fully resolved legally (so could change soon) is whether it's constitutional to have a lifetime ban (as it's currently the case) for people who have been involuntarily committed to a mental institution or adjudicated as a "mental defective" .
The law RIGHT NOW (federal law) bans those people from owning firearms.
Some courts have ruled that the ban shouldn't be lifetime and it should exist a path for rehabilitation, and i suppose that's fair. But there is no shade of doubt about the fact that you can ban someone who is currently very mentally ill from owning firearms, same as you can institutionalized him.
Now how to adjudicate mental illness properly and so on, that's another can of worms.
