Well it's definitely a judgement call unless you go by the constitutional definition. What is the polymarket definition? Can't imagine they'd be taking bets without having one, and if they used the constitutional one it wouldn't be much of a market.

I think this smacks of a needless show of intimidation personally, although they'll probably use the Texas border patrol shooting as an excuse, which wouldn't wash with me anyway, as there's a ton of Federal agencies, many of them law enforcement who carry out their duties without the need for the military.
Is it legal for Federal agents to not identify themselves in such specific operations? It's hardly an undercover operation or sting, so wouldn't they need to have visible identification, in such a specific immigration enforcement context? This seems very shady to say the very least.

Ten people have been charged with attempted murder after allegedly ambushing US Immigration and Customs Enforcement (Ice) agents in Texas on 4 July.
Federal prosecutors said attackers drew the agents out of an Ice detention center in Alvarado, Texas, with fireworks and by vandalizing vehicles. They allegedly shot a police officer in the neck and unloaded between 20 and 30 rounds on immigration agents, and were later apprehended by local law enforcement near the scene.
“It was a planned ambush with the intent to kill Ice correction officers,” said Nancy Larson, US attorney for the northern district of Texas, at a press conference on Monday. “Make no mistake, this was not a so-called peaceful protest – it was indeed an ambush.”
Larson said the assailants began shooting fireworks outside the Prairieland Ice Detection Center, about an hour south of Dallas in Alvarado, Texas, at approximately 10.37pm. The fireworks drew agents outside and found the group spray painting vehicles with “Ice pig”, “traitor” and “other profanity”, according to Larson.

As expected and as predicted they are organizing militarily to try to overcome the state , because that's what enemies of the state do. And they should be treated accordinly. Attempted murder isn't enough, this is seditious conspiracy and everyone involved (including anyone who helped organize the attack even without participating in it at the end) should be put to trial

You know I agree with you that people who do this kind of thing should be given the strongest punishments available, and should expect to be shot (to kill) at the time.
But that's no reason to create a martial law zone 1000 miles away because a few (generally unarmed) people there just using their own body in a defensive manner that isn't effective anyway.
